What is Spain’s Data Protection Act ?

The Spanish Fundamental Law on Data Protection and Digital Rights of 2018 (Data Protection Act) is the data protection and privacy regulation in Spain. This law supplements the European General Data Protection Regulation (GDPR) and tailors its provisions to the particular national context. The “Agencia Española de Protección de Datos” is the supervisory data protection authority in Spain.

The Data Protection Act protects the data privacy of individuals and as such it contains a number of provisions and requirements related to the processing of personal data of individuals. In Spain, the right to privacy includes data privacy, which is a recognized human right and is part of the national Constitution and therefore, is of fundamental value.
