What is South Africa’s Protection of Personal Information Act ?

The Protection of Personal Information Act 4 of 2013 (POPIA) is the major data protection and privacy regulation in South Africa. POPIA aims to promote the protection of personal information processed in South Africa and gives rights to individuals regarding their personal information. POPIA applies to any organization, that processes information in South Africa and specifically regulates the processing of recorded personal information of natural as well as legal persons. 

Similar to the GDPR the POPIA protects the data privacy of individuals and as such it contains a number of provisions and requirements related to the processing of personal data of individuals. The right to privacy is recognized as a fundamental human right in the Bill of Rights of the Constitution of the Republic of South Africa and therefore, of fundamental value.
