What is Ireland’s Data Protection Act ?

The Irish Data Protection Act 2018 (“DP Act”) is the Irish data protection and privacy regulation. The DP Act gives further effect to the European General Data Protection Regulation (GDPR) in Ireland and tailors its provisions to the particular national context. Moreover, it provides for the establishment of a new Data Protection Commission, which is the national independent data protection authority.

The DP Act protects the data privacy of individuals and as such it contains a number of provisions and requirements related to the processing of personal data of individuals. The Constitution of Ireland does not explicitly provide for a right to privacy, but the courts have recognised a right to privacy as one of the personal rights in the Constitution.

This solution will provide your organisation guidance on how to comply with the DP Act and stay compliant with this regulation. In order to also receive guidance on the GDPR, we recommend to use this DP Act solution in combination with the GDPR solution.
